  2. I'll say that I don't think I ever called bullish** on the BS lawsuit. I did call him out that the Pauper ruling wouldn't affect the suit filing. I was right on that.

    However, I don't think with the suit filed, BS can just make it go away so easy. If the judge rules that it wasn't a proper filing, but with respect to Hoge I won't go into that. Or, if he loses the Pauper motion... it won't be so easy for the BS suit to disappear. Again, I defer to Hoge on the fundamentals.

    1. I'm pretty sure this falls under Fed. R. Civ. P. 41(a)(1). Given the early stage, it shouldn't require a court order to dismiss; his letter will be treated as a notice of voluntary dismissal (exactly the way the clerk's office docketed it) and the case does just go away.
